Linkfolia Beta Terms of Service

Welcome to the Linkfolia beta program. These terms explain the rules for your use of Linkfolia while it is in beta. By accessing or using the service you accept and agree to these terms. If you do not agree stop using the beta and follow the account removal steps in Contact information.

Participation in the beta is voluntary. Your use of the beta constitutes acceptance of these terms and consent to the data practices described in our Privacy Policy. You may stop participating at any time by ceasing to use the beta and by contacting [email protected].

You must be at least 13 years old to use the beta unless local law requires a higher age. If we learn that an account belongs to a person under the minimum age we will take steps to remove the account and related personal data in accordance with applicable United States law. If you believe a child under the minimum age provided personal information contact [email protected]. The Children s Online Privacy Protection Act requires verifiable parental consent before collecting personal information from children under 13.

The beta is pre release software and may contain errors security vulnerabilities incomplete features interruptions and other issues. Linkfolia does not guarantee availability performance stability or suitability for any particular purpose during the beta. You accept the risks inherent to beta software and agree that Linkfolia will not be liable for loss caused by using the beta except as required by law.

While you participate in the beta we will collect information to operate test and improve the product. Data types may include usage metrics crash and performance reports device and browser metadata diagnostic logs settings and configuration data content and links you add to your profile and feedback you submit. We collect this data to detect and fix bugs to measure and improve product performance to develop new features to conduct analytics and research and to improve the overall user experience. Aggregated or anonymized information may be used internally and externally to report on product performance and adoption.

The beta may expose participants to pre release features. You agree to keep confidential any information we designate as confidential and not to disclose or publish details about pre release features unless we give written permission. If we require broader confidentiality we may ask you to sign a separate nondisclosure agreement. By providing feedback ideas suggestions bug reports or other input you grant Linkfolia a perpetual worldwide royalty free transferable sublicensable non exclusive license to use copy modify display and distribute that feedback for any purpose. This feedback license does not affect your ownership rights in your content.

You retain ownership of content you post to Linkfolia subject to the license you grant us above. Linkfolia may suspend or terminate your beta access at any time. On termination we may remove or make unavailable beta only features and content in line with our privacy and data retention policies. If you want to retain a copy of your content back up your content before termination. Requests for account closure should be sent to [email protected].

The beta may integrate with third party services and those integrations are subject to the terms of the third parties. Linkfolia is not responsible for third party content or practices. If you believe content hosted on Linkfolia infringes your rights follow the notice procedures in our copyright policy or contact [email protected] with a complete takedown request.

You agree not to use the beta to infringe the rights of others distribute malware attempt unauthorized access to systems or otherwise interfere with the normal operation of the service. Report abusive content safety concerns or security vulnerabilities to [email protected]. We may suspend or terminate accounts that violate these terms.

You may not register or use domain names, usernames, display names, or other identifiers on Linkfolia that: (a) are designed to mislead others about affiliation with Linkfolia, third parties, or any government or emergency service; (b) impersonate another person or organization; (c) facilitate phishing, malware, fraud, or other malicious activity; or (d) could reasonably be confused with system or infrastructure identifiers (for example: admin, support, security, server, mail, smtp, host, root, system, localhost). Linkfolia reserves the right to block, reclaim, suspend, rename, or remove any identifier that it reasonably determines violates this provision, and to take additional actions including account suspension, content removal, and reporting to authorities. If you require a specific identifier for a legitimate technical reason, contact [email protected] with a justification.

You will comply with applicable United States export control economic sanctions and other laws and will not use the beta in a manner that violates those laws. You will not permit use of the service from any jurisdiction or by any party that is subject to applicable prohibitions.

We implement reasonable technical and organizational safeguards to protect personal data appropriate to the nature of the data and the risks involved. If we become aware of a data breach affecting personal data we will take prompt action to contain and investigate the incident and will notify affected users and regulators as required by applicable United States federal and state law.

THE BETA IS PROVIDED AS IS AND AS AVAILABLE WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW LINKFOLIA DISCLAIMS ALL WARRANTIES WHETHER EXPRESS IMPLIED STATUTORY OR OTHERWISE INCLUDING WARRANTIES OF MERCHANTABILITY FITNESS FOR A PARTICULAR PURPOSE AND NON INFRINGEMENT. TO THE MAXIMUM EXTENT PERMITTED BY LAW LINKFOLIA WILL NOT BE LIABLE FOR ANY INDIRECT INCIDENTAL CONSEQUENTIAL SPECIAL EXEMPLARY OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR PARTICIPATION IN THE BETA EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL LINKFOLIA AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS EXCEED THE GREATER OF ONE HUNDRED DOLLARS UNITED STATES DOLLAR OR THE AMOUNT YOU HAVE PAID LINKFOLIA FOR THE BETA DURING THE PRIOR SIX MONTHS. Nothing in this section is intended to limit rights that cannot be limited under applicable consumer protection laws.

You agree to indemnify defend and hold Linkfolia and its officers directors employees and agents harmless from any claims liabilities losses and expenses arising from your violation of these terms your negligence or your use of the beta.

These terms are governed by the laws of the State of Colorado United States without regard to conflict of law rules. For disputes you and Linkfolia agree to submit to the personal jurisdiction of the federal and state courts located in Denver Colorado. Alternatively we may require binding arbitration for disputes subject to a separate arbitration agreement. If we adopt binding arbitration you will be given a clear opportunity to opt out of arbitration within 30 days of first agreeing to these terms by sending a written notice to [email protected]. Certain statutory rights cannot be waived in some jurisdictions and this clause will be interpreted accordingly.

We may modify these terms or end the beta at any time. If we make material changes we will notify you by posting an updated version and updating the effective date. Continued use of the beta after changes constitutes acceptance of the updated terms.

Linkfolia allows links that direct to adult content as long as such content complies with applicable laws and regulations. However, users may not upload, display, or use adult content in their profile pictures, usernames, or on their Linkfolia profile pages. Any explicit or pornographic imagery or text within a profile itself is strictly prohibited.
